Disciplinary Procedures
and Penalties

The HCA 2010 Disciplinary
Procedures and Penalties relate to offences that breach the 'HCA 2010
Code of Conduct' and the 'HCA 2010 Rules and Regulations'.
i. In the first instance
of an offence, the umpire(s) shall warn the offender(s) that their behaviour
is in contravention of the HCA Code of Conduct or HCA Rules and Regulations.
Each umpire will be made aware of the warning.
ii. In the second
instance, the umpire(s) shall again warn the offender(s) and will also
inform their captain that the second and final warning has occurred.
Each umpire will be made aware of the second warning. All 'Final Warnings'
must be officially recorded in the umpire's Match Report.
iii. In the third
instance, the umpire(s) shall inform the offender(s) that they have
again breached behavioural expectations and will automatically be referred
to the HCA Disciplinary Board for adjudication. Each umpire and both
captains will be made aware of the third breach and the consequent referral,
which must also be recorded in the umpire's Match Report.
*NOTE: The offence
does not need to be the same for each warning; it need only be a recurrence
of any action that contravenes the HCA Code of Conduct or HCA Rules
and Regulations. Also, a single incident can result in more than one
warning (e.g. if the offender persists after being issued the initial
warning).
*EXCEPTION to 'three
strikes' procedure: Should the offence be that of deliberately causing
or attempting to cause physical harm, there will be no warning and the
offender will be immediately ordered to take no further part in the
game. The matter will be automatically referred to the HCA Disciplinary
Board for adjudication.
- Reporting
- The Umpire's Match Report
will officially record any occurrence of any individual or team receiving
two or more warnings in the match.
- Referral to HCA Disciplinary
Board
- Any individual or team reported
for committing three or more offences (i.e. being reported after a Final
Warning) in the same match will automatically be referred by the umpire(s)
to the HCA Disciplinary Board.
- Any individual or team receiving
a Final Warning in two different matches in the same season will automatically
be referred by the umpire(s) to the HCA Disciplinary Board.
- Assessment of Referrals
- Within 48 hours of the completion
of the match each umpire is required to submit to the HCA Disciplinary
Board a detailed Disciplinary Report for any individual or team that
they have referred.
- Within 48 hours of the completion
of the match each captain has the opportunity to provide a written report
to the HCA Disciplinary Board.
- The HCA Disciplinary Board,
either umpire, or either captain may request any individual(s) involved
to present a written report, and must inform the other mentioned parties
of this request. Such reports must be submitted within 48 hours of the
completion of the match.
- No individual player may directly
make the request to provide a written report; the request must come
through their captain.
- After receiving the above
reports, the HCA Disciplinary Board may at any time request additional
individuals to submit a written report, which must be submitted within
48 hours of the request to do so.
- Adjudication
- The HCA Disciplinary Board
aims to inform the HCA Executive Board of their recommended verdict
within five days of the completion of the match.
- A representative of the HCA
Executive Board aims to announce the final decision within one week
of the completion of the match.
- The final decision will be
announced via e-mail to the HCA Disciplinary Board, the referred individual(s)
or team(s), the umpires reporting the matter, and all HCL captains.
- The captain(s) of the referred
player(s) or team(s) will be informed by telephone that the e-mail was
sent.
- Only in exceptional circumstances
should the above process extend beyond the stated deadlines.
- The HCA Disciplinary Board
and the HCA Executive Board have the authority to call a 'Disciplinary
Hearing', and have the sole discretion of who is invited to attend.
This will most likely include the umpire(s), both captains and the referred
individual(s).
- All verdicts are effective
immediately, and can only be suspended by official appeal (see below).
- Appeals
- Captains may appeal a verdict
regarding player(s) in their team, by informing a member of the HCA
Executive Board by e-mail or telephone that they wish to appeal.
- Any appeal must be made within
72 hours of the announcement of the verdict.
- The official lodging of an
appeal will result in the suspension of the verdict until the appeal
has been acted on by the HCA.
- The original verdict is only
suspended once the appeal is officially acknowledged by a member of
the HCA Executive Board. Until then the original verdict remains
and a banned player cannot play.
- The appeals procedure will
be the same as for the original assessment of the case, excepting that
either captain may request a 'Disciplinary Hearing' to be held,
and/or may submit a written report detailing the reasons for appeal.
- The result of an appeal may
be that the original penalty is dismissed, reduced, maintained, or increased
up to a maximum of twice the original penalty.
- Should an appeal result in
the original penalty being completely dismissed, the matter will not
count as a 'previous offence'.
- Penalties
- Offences have been categorized
according to 'Levels'.
- Where varied offences are
reported, the penalty applying to the most serious offence will be applied.
- Offences are reportable whether
they happen on or off the field of play.
- Spectators may also be warned
and reported.
- Repeat referrals of an individual
or team to the HCA Disciplinary Board in the same season may result
in subsequent penalties being increased up to a maximum of twice the
general recommendation.
- Penalties that cannot be completed
prior to the end of the season will be carried over to the next season.
- Level One Offence
- recommended penalty: player misses one HCL match
Level
One Offences include:
- Dissent (verbal or non-verbal)
towards an umpire's decision.
- Serious or persistent 'sledging'
that the umpire judges to be beyond acceptable 'on-field banter'.
- Deliberately hitting or knocking
over the stumps.
- Throwing or kicking a bat,
the ball or any other equipment in reaction to a disputed decision.
- When appealing, 'charging'
towards an umpire in an aggressive manner before their decision has
been made (applies even if the batsman is subsequently given 'out').
- Excessive appealing or any
appealing that the umpire judges to be 'ridiculous'.
- 'Sending off' a batsman
after they have been dismissed.
- Repeated bowling of fast short-pitched
balls or fast high full tosses.
- Deliberate time wasting.
- Level Two Offence
- recommended penalty: player misses two or three HCL matches
Level
Two Offences include:
- Aggravated dissent towards
an umpire's decision (e.g. extended or repeated dissent, or dissent
that is accompanied by physically aggressive mannerisms, etc).
- Making comments or gestures
that are obscene, offensive, or insulting.
- Threatening or intimidating
behaviour, either verbally or via aggressive gestures.
- Deliberate 'ball tampering'
(refer to Law 42.3).
- Level Three Offence
- recommended penalty: player misses four or more HCL matches
Level
Three Offences include:
- Threatening to physically
assault a player, spectator, or umpire.
- Deliberate and aggressive
physical contact against a player, spectator, or umpire.
- Making comments that vilify
any other person or group of people according to their race, religion,
colour, sexual orientation, or national or ethnic origin.
- Disregarding an official HCA
disciplinary verdict (also a Level Two Team Offence - see 3.6 below).
- Expulsion Offence -
player to be expelled from the HCL for the duration deemed appropriate
by the HCA Executive Board, having considered the period recommended
by the HCA Disciplinary Board.
Expulsion
Offences include:
- Physically assaulting any
other person at any time, in any location, in any way that is considered
to be connected to any HCA match or event.
- Excessively repetitive offences
by the same individual or team
- Team Captain Offences
- If the team captain has been
reported, the penalty may be increased to a maximum of twice the general
recommendation.
- Team Offences
- If several members of a team
are reported in the Umpire's Match Report, the matter(s) may be referred
to the HCA Disciplinary Board as a 'Team Offence'.
- The team may be penalized
points according to the 'level' to which they are judged as a team
to have offended (using the guidelines above).
- Recommendations for team points
deductions are as follows: Level One Team Offence: 2 points; Level Two
Team Offence: 4 points; Level Three Team Offence: 6 or 8 points.
- Any player deemed to have
individually offended at a level higher than the 'Team Offence'
may be penalized separately, in addition to the Team Penalty.
- The participation of any banned
player in a match will be treated as a Level Two Team Offence, AND as
a Level Three individual offence.
- Alternative or Additional
Penalties
In addition to -
or instead of - any of the above penalties, for any offence, the HCA
Disciplinary Board and the HCA Executive Board reserve the right to:
- Dismiss a matter with no penalty,
not counting it as a 'previous offence'.
- Reprimand and warn an individual
or team as to future conduct.
- Require an individual or team
to submit a written apology to any offended parties.
- Treat a repeatedly (more than
twice) penalized individual's offence as a 'Team Offence'.
- Suspend or expel an individual
or team from the League for any duration.
- Unreported Incidents
If a captain feels
that an unreported incident should be brought to the attention of the
HCA Disciplinary Board, they must submit a written report to the board
within 48 hours of the completion of the match. The HCA Disciplinary
Board will consult with the umpire(s) to decide on the appropriate course
of action and will respond to the report within 5 days. If necessary,
disciplinary procedures will be followed.
